Welcome to Baru Skin Care. These Terms of Service ("Terms") govern your use of our website, our online booking system, our loyalty program, and the services we provide at our Mount Vernon, NY studio.

By accessing our website, booking an appointment, purchasing a gift card, or receiving services from Baru Skin Care LLC ("Baru Skin Care," "we," "our," or "us"), you agree to be bound by these Terms. If you do not agree with any part of these Terms, please do not use our website or services.

1. About Baru Skin Care

Baru Skin Care LLC is a licensed skincare studio located at:

We are owned and operated by Alejandra, a New York State Licensed Esthetician (Control Number: 23252-14) with additional certifications including:

• Life-Changing Oncology Esthetics® Specialist (License # AEE-T-22-10320)

• Dermaplaning Techniques Certification

• Esthetics for Laser Hair Removal Certification

• Domestic Violence Response Training Certification

• Barbicide Sanitation Certification

2. Eligibility

By using our services, you confirm that:

• You are at least 18 years of age, OR

• You are under 18 and have the consent and supervision of a parent or legal guardian

• You have the legal authority to enter into this agreement

• You are accessing our services from within the United States

We provide services to clients located in New York State. While we welcome out-of-state visitors who travel to our studio, our services and website are designed for New York-based clients.

3. Services Offered

Baru Skin Care provides professional skincare services, including but not limited to:

• Customized facials (Baru Facial, Express Facial, Anti-Aging, Acne Treatment, Back Facial)

• Dermaplaning treatments

• Hyperpigmentation treatments

• Paraffin wax treatments

• Spa packages and group bookings

• Oncology-safe skincare services (see Oncology Client Disclaimer)

• Skincare product sales

We reserve the right to:

• Modify, update, or discontinue any service at any time

• Adjust pricing without prior notice

• Refuse service to any individual at our discretion (see Section 11)

4. Booking and Payment Terms

Online Booking Appointments may be booked online through our website using Wix Bookings, by phone, or by email.

Deposit Required A deposit is required to secure your appointment:

• Standard skincare services: $30 deposit

• Oncology Skin Consultation: $50 consultation fee

• Group bookings and spa parties: Deposit determined at the time of booking

Deposits are applied as a credit toward the total cost of your service. Deposits are non-refundable except in limited circumstances outlined in our Cancellation Policy.

Payment Methods Accepted

• Credit and debit cards (via Wix Payments)

• Zelle

• Cash (in-studio only)

• Gift cards issued by Baru Skin Care

Payment Timing The remaining balance is due at the time of service. We do not offer installment payment plans.

Pricing Changes We reserve the right to change service prices at any time without prior notice. The price quoted at the time of booking will be honored for that specific appointment.

5. Cancellations, Rescheduling, and No-Shows

All cancellation, rescheduling, and no-show terms are governed by our Cancellation & No-Show Policy, which is incorporated by reference into these Terms.

By booking an appointment, you acknowledge that you have read and agreed to our Cancellation Policy.

6. Refunds

All refund terms are governed by our Refund Policy, which is incorporated by reference into these Terms.

7. Gift Cards

Baru Skin Care offers gift cards available for purchase online and in-studio. The following terms apply to all gift cards:

Expiration Gift cards issued by Baru Skin Care do not expire, in accordance with New York State law.

Minimum Value The minimum gift card value must be equal to or greater than the price of one full service, unless a custom amount is approved by Baru Skin Care.

Use Gift cards may be redeemed for any skincare service offered by Baru Skin Care.

Transferability Gift cards are transferable and may be given to another person.

Refunds Gift cards are non-refundable and cannot be exchanged for cash, except where required by law (such as balances under $5 in New York State).

Lost or Stolen Gift Cards We are not responsible for lost, stolen, or damaged gift cards. Please treat your gift card like cash.

8. Loyalty Program

Baru Skin Care offers a points-based loyalty program managed through our website. The program works as follows:

How to Earn Points

• Sign up to the site: 50 points

• Book a session: 10 points per booking

• Order a plan or service: 1 point for every $1 spent

How to Redeem Points

• 10 points = 10% off all services

• 10 points = 10% off a specific service

• 10 points = $1 discount (flexible reward)

Loyalty Program Terms

• Points have no cash value and cannot be transferred or exchanged for cash

• Points may not be combined with certain promotions, packages, or discounts

• We reserve the right to modify, suspend, or terminate the loyalty program at any time

• Fraudulent activity may result in forfeiture of accumulated points

• Points may expire after periods of account inactivity, as determined by Baru Skin Care

9. Multi-Session Packages

Baru Skin Care may offer multi-session packages or bundled services from time to time. The following terms apply to all packages:

• Packages are non-refundable once purchased

• Unused sessions within a package are non-transferable to cash

• Packages may have expiration dates, which will be disclosed at the time of purchase

• Specific package terms will be provided in writing at the time of sale

10. Products and Shop

Baru Skin Care sells skincare products through our online Shop. All product sales are governed by our Refund Policy.

Product Information We strive to display accurate product descriptions, ingredients, and pricing. However, we do not guarantee that all information on the website is free from error. If you receive a product that differs significantly from its description, please contact us immediately.

Allergies and Reactions You are responsible for reviewing product ingredients and consulting your healthcare provider if you have allergies, sensitivities, or medical conditions that may be affected by skincare products. Baru Skin Care is not liable for adverse reactions to products you purchase and use independently.

11. Right to Refuse Service

Baru Skin Care reserves the right to refuse, terminate, or postpone service at our discretion, including but not limited to situations involving:

• Disrespectful, threatening, or abusive behavior toward staff or other clients

• Failure to follow studio policies or health and safety protocols

• Failure to provide accurate health information or consent forms

• Suspected fraudulent activity (including chargebacks made in bad faith)

• Repeated no-shows or cancellation policy violations

• Arrival under the influence of drugs or alcohol

• Children left unsupervised in the studio

• Active contagious illness or condition that compromises safety

• Any situation that, in Alejandra's professional judgment, makes service unsafe

We may decline service without offering a refund of services already rendered. Deposits may be forfeited in cases of policy violation.

12. Studio Conduct

To maintain a peaceful, professional environment for all clients, we ask that you observe the following while at Baru Skin Care:

• Phone calls: Live phone calls are not permitted during services. You may use your phone for messaging or quietly while in the waiting area.

• Children: Children must be supervised at all times by an accompanying adult. We cannot supervise unattended children.

• Respectful behavior: Please treat staff, other clients, and the studio space with respect.

• Outdoor relaxation area: Clients are welcome to use the outdoor space before or after their service.

• Personal belongings: You are responsible for your personal items. Baru Skin Care is not liable for lost, stolen, or damaged belongings.

13. Chargebacks and Disputes

If you have an issue with a payment, service, or product, we encourage you to contact us first to resolve the matter directly. We are committed to working with clients in good faith to address legitimate concerns.

Fraudulent Chargebacks Filing a chargeback without first attempting to resolve the issue with us, or filing a fraudulent chargeback, may result in:

• Permanent denial of future services

• Submission of supporting documentation (intake forms, signed consent, appointment records, receipts) to your payment provider as evidence

• Pursuit of any unpaid balance through legal means

• Reporting the activity to relevant authorities

Baru Skin Care maintains detailed records of all client interactions, including signed intake forms, booking confirmations, and service receipts, which serve as evidence in chargeback disputes.

14. Health Disclosures and Client Responsibilities

When booking services with Baru Skin Care, you agree to:

• Provide complete and accurate information on intake forms

• Disclose all relevant medical conditions, medications, allergies, and treatments

• Notify us of any changes to your health between visits

• Follow all pre-treatment and aftercare instructions

• Communicate openly with Alejandra about your skin concerns and treatment goals

Failure to disclose accurate health information may compromise your safety and may release Baru Skin Care from liability for any resulting reactions or outcomes.

15. Photography and Social Media

By becoming a client, you acknowledge that Baru Skin Care may request to photograph your skin or treatment for documentation, educational, or marketing purposes. All photo and social media use is governed by our Privacy Policy.

You have the right to decline photography or social media use at any time.

16. Intellectual Property

All content on the Baru Skin Care website — including text, images, graphics, logos, photographs, and the "Baru Skin Care" name — is the property of Baru Skin Care LLC or its content suppliers and is protected by applicable copyright and trademark laws.

While the "Baru Skin Care" name and logo are not currently registered trademarks, they are protected under common law trademark rights through continuous business use.

You may not copy, reproduce, distribute, modify, or create derivative works from any content on our website without our prior written permission.

17. Limitation of Liability

To the fullest extent permitted by law, Baru Skin Care LLC, its owner, employees, and affiliates shall not be liable for:

• Adverse reactions resulting from undisclosed medical conditions, medications, or treatments

• Outcomes resulting from your failure to follow pre-treatment or aftercare instructions

• Indirect, incidental, consequential, or punitive damages of any kind

• Loss of personal property while at the studio

• Outcomes affected by your underlying medical condition or treatments performed by other providers

• Reactions to products purchased and used independently

In no event shall our total liability to you for any claim arising from your use of our services or website exceed the total amount you paid for the specific service or product giving rise to the claim.

This limitation does not apply to gross negligence, willful misconduct, or any liability that cannot be limited under New York State law.

18. Indemnification

You agree to indemnify, defend, and hold harmless Baru Skin Care LLC, its owner, employees, and affiliates from any claims, damages, losses, liabilities, costs, or expenses (including attorney's fees) arising from:
