This document outlines important information for clients receiving services through the Baru Skin Care Oncology-Safe Skincare Program. Please read this disclaimer carefully before scheduling or receiving any oncology-related skincare service.
By booking an Oncology Skin Consultation, an Oncology-Safe Facial, or a Barrier Repair Facial Therapy with Baru Skin Care LLC, you acknowledge that you have read, understood, and agreed to the terms outlined in this document.
1. About Our Oncology-Safe Skincare Program
Baru Skin Care LLC, owned and operated by Alejandra, is a licensed skincare studio offering specialized services for individuals undergoing cancer treatment or in recovery.

Our Oncology-Safe Skincare Program is offered exclusively at our Mount Vernon, NY studio (16 Primrose Ave, Mount Vernon, NY 10552). Services are designed to provide comfort, hydration, and emotional support during the cancer journey, using gentle, evidence-based techniques and carefully selected products appropriate for clients with cancer-related skin changes.
2. Important Medical Disclaimer
Baru Skin Care is not a medical provider. Alejandra is a licensed esthetician with specialized training in oncology-safe skincare techniques. She is not a doctor, nurse, dermatologist, oncologist, or any other type of medical professional.
Our services are designed to support skin health, comfort, and well-being. They are not:

A substitute for medical care, treatment, or advice

A treatment, cure, or therapy for cancer or any other medical condition

Capable of preventing, diagnosing, or healing cancer-related conditions

A replacement for prescribed medications, treatments, or therapies
Any information provided during your consultation or service is for educational and skincare purposes only. It is not intended to diagnose, treat, cure, or prevent any disease or medical condition. Please consult your oncologist, dermatologist, or primary care physician regarding any medical concerns.
3. Required Oncology Skin Consultation
All new oncology clients are required to complete an Oncology Skin Consultation before receiving any facial service. This consultation is mandatory and cannot be waived.
The consultation includes:

A detailed review of your medical history

Discussion of current or recent cancer treatments, including chemotherapy, radiation, immunotherapy, hormone therapy, and surgical procedures

Review of current medications and supplements

A gentle skin assessment

Identification of any contraindications

Personalized skincare recommendations
-
Development of a treatment plan tailored to your needs
Consultation Fee: $50
The consultation fee is paid at the time of booking. It is non-refundable under normal circumstances, but is applied as a credit toward your first Oncology-Safe Facial or Barrier Repair Facial Therapy when scheduled within 30 days of your consultation.
Full Refund Exception: If Alejandra determines during your consultation that she cannot safely provide services to you due to medical contraindications, your $50 consultation fee will be fully refunded.
4. Medical Clearance
For your safety, Baru Skin Care requires written medical clearance from your oncologist, primary care physician, or medical treatment team before performing oncology-related skincare services. This clearance confirms that your medical team is aware of and approves your participation in professional skincare services.
Medical clearance should include:

Confirmation that your physician is aware of the services being received

Any contraindications, restrictions, or precautions specific to your case

Approval for the requested service type
Clearance requirements are applied on a case-by-case basis during your consultation. In some situations, Alejandra may:

Request additional documentation

Recommend that you delay services until further clearance is obtained

Decline service if proper clearance cannot be confirmed
Without proper medical clearance, services may not be performed.
5. Services Offered
The following services are available through our Oncology-Safe Skincare Program:
Oncology Skin Consultation — $50 | 30–45 minutes A professional consultation designed to evaluate skin health, review medical history, discuss current treatments, and determine the safest skincare approach for each client.
Oncology-Safe Facial — $130 | 60 minutes A specialized facial created specifically for individuals undergoing cancer treatment or in recovery. Includes gentle cleansing, ongoing skin assessment, hydrating and calming treatments, barrier-support products, and relaxation techniques when appropriate.
Barrier Repair Facial Therapy — $150 | 75 minutes An advanced hydration treatment focused on restoring and strengthening a compromised skin barrier. Ideal for clients experiencing severe dryness, sensitivity, treatment-related skin changes, or anyone needing intensive hydration support.
6. Acknowledgment of Risks
While our services are designed to be gentle, safe, and supportive, all skincare treatments carry some level of risk — particularly for clients with cancer-related skin changes. By proceeding with any oncology-safe service, you acknowledge and accept the following risks:

Temporary skin reactions, including redness, sensitivity, dryness, or mild irritation

Increased skin sensitivity due to cancer treatments, medications, or compromised skin barriers

Unforeseen reactions to skincare products, even those formulated for sensitive skin
-
Slow healing or extended recovery from minor skin disturbances
-
Emotional sensitivity during or after treatment
You understand that even with thorough consultation and medical clearance, individual responses to skincare services can vary. Baru Skin Care cannot guarantee specific results or outcomes.
7. Conditions Where Service May Be Declined
For your safety, Baru Skin Care reserves the right to decline, modify, or postpone services if any of the following conditions are present:

Active fever, infection, or illness

Open wounds, sores, blisters, or active rashes in the treatment area

Recent radiation therapy to the treatment area (within timeframes determined during consultation)

Recent surgery without proper healing time and medical clearance
-
Active herpes outbreak or other contagious skin condition

Signs of allergic reaction or severe skin compromise
-
Lack of required medical clearance
-
Any condition that, in Alejandra's professional judgment, makes service unsafe at that time
If service is declined or postponed for safety reasons:

Your appointment may be rescheduled at no additional cost
-
If safety concerns cannot be resolved, your $50 consultation fee will be fully refunded
8. Your Responsibilities as a Client
To help ensure your safety and the best possible outcome, you agree to:

Provide complete and accurate information about your medical history, treatments, and medications

Inform Alejandra of any changes to your health status, medications, or treatment plan between visits

Obtain and provide medical clearance from your physician when requested
-
Follow all pre-treatment and post-treatment care instructions provided
-
Notify Alejandra immediately if you experience discomfort, pain, or unusual reactions during or after a service
-
Disclose any new diagnoses, medications, or treatments that occur during your time as a client
Failure to disclose relevant medical information may compromise your safety and may release Baru Skin Care from liability for any resulting reactions or outcomes.
9. Informed Consent
By signing the intake form, paying the consultation fee, and proceeding with any oncology-safe skincare service, you certify that:

You have had the opportunity to ask questions and have received satisfactory answers

You understand that services are supportive in nature and not medical treatment

You have disclosed all relevant medical information accurately and completely

You voluntarily consent to receiving the services described

You understand the risks outlined above and accept them

You release Baru Skin Care LLC, Alejandra, and any affiliated parties from liability for outcomes that occur despite reasonable professional care, provided that information you disclosed was accurate and instructions were followed

You agree to follow all aftercare and safety instructions provided
10. Photography and Social Media
Documentation of skin progress through photography may be used for personal client records and, with your permission, for educational or marketing purposes on our social media platforms (Instagram, Facebook, TikTok, YouTube).
For oncology clients, we follow a stricter photo and social media policy:

Written or verbal consent will be obtained in person before any photos are taken

Separate consent will be obtained in person before any photo is posted publicly

You may decline photography entirely at any time without affecting your service

You may request the removal of any previously posted photo at any time
-
Identifying features may be obscured or cropped upon your request
Your privacy and dignity are our priority. You are in complete control of how, when, and whether your image is shared.

11. Confidentiality
All information shared with Baru Skin Care during your consultation and services is strictly confidential. Your medical history, treatment information, and personal details are protected under our Privacy Policy and applicable New York State privacy laws, including the New York SHIELD Act.
Information will not be shared with any third party without your explicit written consent, except where required by law.
12. Caregivers and Support Persons
We welcome the presence of caregivers, family members, or support persons during your appointment. You may choose to have a support person:

In the treatment room with you during your service

In the waiting area or outdoor relaxation space

Not present at all
Please let us know your preference at the time of booking or upon arrival.
13. Emergency Protocol
In the unlikely event of an adverse reaction or medical emergency during a service:

Service will be stopped immediately

Appropriate first aid will be administered as needed

Emergency services (911) will be contacted if the situation warrants
-
Your emergency contact and/or physician may be notified
-
The incident will be thoroughly documented for your records
We strongly encourage you to provide accurate emergency contact information and ensure that your physician's information is on file before your first service.
14. Cancellation, Rescheduling, and Refunds
The following policies apply specifically to oncology-related services:
Cancellation by Client (Standard) We require a minimum of 24 hours' notice for cancellation of any oncology appointment. Cancellations made with less than 24 hours' notice may result in a charge of 50% of the scheduled service. No-shows or same-day cancellations may be charged the full amount.
Cancellation Due to Illness or Treatment Changes We understand that cancer treatment can be unpredictable. If you need to cancel or reschedule due to a sudden change in your treatment, illness, or medical situation, please contact us as soon as possible. We will work with you compassionately and will not apply standard cancellation penalties in such cases.
Cancellation by Baru Skin Care If Alejandra determines after consultation that services cannot be safely provided, your $50 consultation fee will be fully refunded. If a scheduled treatment must be canceled by Baru Skin Care for any reason, you will receive a full refund of any prepayment.
Late Arrivals A 15-minute grace period is provided. Arrivals beyond 15 minutes late may result in a shortened service or, at Alejandra's discretion, rescheduling. No refunds will be issued in such cases.

15. Limitation of Liability
To the fullest extent permitted by law, Baru Skin Care LLC, its owner, employees, and affiliates shall not be liable for:

Adverse reactions resulting from undisclosed medical conditions, medications, or treatments

Outcomes resulting from your failure to follow pre-treatment or aftercare instructions
-
Indirect, incidental, or consequential damages of any kind
-
Outcomes affected by your underlying medical condition or cancer treatment

Decisions made by your medical team or other healthcare providers

Reactions to products used outside of services received at Baru Skin Care
In no event shall our total liability to you for any claim arising from oncology-related services exceed the total amount you paid for the specific service giving rise to the claim.
This limitation does not apply to gross negligence, willful misconduct, or any liability that cannot be limited under New York State law.
16. Indemnification
You agree to indemnify, defend, and hold harmless Baru Skin Care LLC, its owner, and affiliates from any claims, damages, losses, liabilities, costs, or expenses (including attorney's fees) arising from:

Your failure to disclose accurate medical information

Your failure to follow pre-treatment or aftercare instructions

Your violation of any policy outlined in this disclaimer

Any third-party claim related to information you provided or services you received
17. Governing Law
This disclaimer and any disputes arising from or related to services provided by Baru Skin Care are governed by the laws of the State of New York, without regard to its conflict of laws principles. Any legal action must be brought in the state or federal courts located in Westchester County, New York.
18. Changes to This Document
Baru Skin Care reserves the right to update this disclaimer at any time. The "Last Updated" date will reflect any changes. Continued use of our oncology services after changes are posted constitutes acceptance of the updated terms.
For significant changes, current oncology clients will be notified by email or in person.
